2006United States v. Philip Morris — RICO liability for fraudulent denial of smoking harms — Judge Gladys Kessler found the major cigarette manufacturers, including R.J. Reynolds, liable under RICO for a decades-long scheme to deceive the public about the health effects and addictiveness of smoking, while their own internal research documented both. Affirmed by the D.C. Circuit in 2009. This is a judicial finding of knowing deception, not an allegation — the clearest `intentional` finding in this catalog.
1998Tobacco Master Settlement Agreement — R.J. Reynolds was among the manufacturers settling state suits to recover public health-care costs of smoking, agreeing to perpetual annual payments and to dissolve industry research bodies used to manufacture doubt. The MSA followed the same conduct the RICO ruling later characterised as knowing deception.
2023BAT — $635M DOJ resolution over North Korea sanctions and bank fraud — British American Tobacco, parent of Reynolds American, entered a deferred prosecution agreement and paid roughly $635M after DOJ charged a conspiracy to sell tobacco products to North Korea through third parties in violation of sanctions.
